Supreme Court Bars BCI Action Against NALSAR Law Students, Limits Its Authority
Supreme Court rules that the Bar Council of India cannot take action against NALSAR University law students, holding that the concerned university is the competent authority in student-related matters.
The case relates to a recent controversy involving students of NALSAR University, who had opposed the invitation extended to the Chief Justice of India (CJI) to attend the university’s convocation ceremony.
Following the students’ opposition, the BCI issued a letter taking action against the university students. The action included a decision to stop their enrolment, triggering legal proceedings against the move.
A petition was subsequently filed in the matter before the Supreme Court. After the Supreme Court intervened, the BCI was required to withdraw the disputed order.
The Supreme Court has now delivered its detailed judgment in the matter. In its ruling, the court held that the concerned university would be the competent authority to take any action relating to its students.
The court did not recognise any authority of the BCI to take action against the law students in the matter. The ruling establishes that student-related action in such circumstances falls within the authority of the respective university, rather than the Bar Council of India.
